Claim: Citi TV alleges President John Mahama has appointed Justice Paul Baffoe-Bonnie as the acting Chief Justice hours after he suspended Justice Gertrude Torkornoo.
Verdict: Misleading. JUSTFACT GHANA’s investigations revealed President Mahama did not appoint Justice Baffoe-Bonnie as the country’s acting Chief Justice.
Article 144 Section 6 (B) of Ghana’s 1992 Constitution provides that in the absence of the Chief Justice, the “most senior” among the Supreme Court justices will perform the functions of the Chief Justice. The role automatically falls on Justice Baffoe-Bonnie, who is the senior-most Justice among his peers.
